Job overview
We are looking to recruit a band 8d Head of Domain in one of our 3 public law domains.
The Legal Team is a part of NHS England’s Delivery Directorate and provides legal advice, support and expertise to the whole organisation to promote good decision making, controls and accountability to Parliament and to deliver better outcomes for patients. We provide an accessible, high quality legal service that enables NHS England to comply with the law, manage legal risk, make effective decisions and demonstrate itself as being a well-run leader of the NHS. The team is made up of a number of sub/mini teams known as Domains, each specialising in a particular area of law. This role heads up the Public Law – Corporate and Medicines domain and requires a candidate who can demonstrate relevant public law skills and understanding as well as the ability to effectively lead a mini team.
In addition to leading the Domain, the post holder will work as part of a dynamic, wider team delivering an effective legal service supporting NHS England’s Board, committees, CEO, national and regional directors, directorates and teams to exercise NHS England’s statutory functions effectively, manage risk, respond to legal matters arising in a timely and accurate manner, and act lawfully at all times.

The Head of Public Law – Corporate and Medicines is a key member of the Legal team, reporting into one of the Deputy Directors of Legal, and working closely, in particular, with the other two Heads of public law domains.
As Head of Domain, the individual is responsible for directly managing a team of lawyers, securing the provision of high-quality legal advice to NHS England in the areas within the domain’s remit and, in conjunction with other Heads of Domain and the Deputy Directors of Legal, supporting the leadership and management of the wider Legal Team.
The Public Law – Corporate and Medicines Domain undertakes a broad range of legal work with a particular specialism in the corporate activities of the organisation including internal governance, emergency preparedness and resilience, the interpretation of general statutory duties & functions, finance & pricing and medicines value & access (ie making available medicines for the NHS providers). The domain is also responsible for managing our team of property lawers . Candidates will need to demonstrate their experience in one or more of the public law areas and the ability to swiftly develop an expert knowledge of their wider portfolio to enable effective execution and oversight of the work of the Domain.

Detailed job description and main responsibilities
The main duties and responsibilities of the role are set out in the Job Description.
You will be responsible for advice (both personal and that of the domain) on the underpinning legislation for NHS England, to senior decision makers often personally and at pace, as well as maintaining and improving an agile advice service for others in the organisation. This frequently means having a fast, solution focus that is able to articulate risk and opportunity to facilitate informed and efficient decision making.
In addition to the provision and oversight of legal advice, the Head of Domain will have responsibility for:
· line managing the senior healthcare and healthcare lawyers in the domain;
· oversight of the work of the domain and domain outsourcing to external law firms;
· managing external legal advice and firms;
· meeting domain reporting requirements;
· securing the collation and analysis of domain data via our case management system to ensure continual improvement of legal advice and client care and that the organisation receives effective and value for money legal advice; and
· devising and implementing strategies to ensure the smooth and compliant running of the Domain in line with wider team requirements
Candidates for the role will need to be able demonstrate in depth knowledge of public law in a health setting, highly developed legal advisory and drafting skills, and the ability to provide senior decision makers with pragmatic, facilitative advice at pace in the context of NHS England’s legal landscape.
The role requires leadership, vision, strategic thinking and planning with political skills, and the ability to demonstrate a high level of expertise in providing senior leadership.
Candidates will also need the ability to make decisions autonomously and have sound judgment in absence of clear guidelines or precedent, the ability to work on own initiative, allocating work as necessary, and highly developed communication skills. You will need to work well with others and across boundaries, be able to rapidly build good relationships, and be positive and helpful, someone who listens, involves, respects and learns from the contribution of others whilst making their own contributions to the Domain and wider team.
